Mr. Conner called the meeting to order and explained procedures for the evening.


CASE NO. 3405 – S & C CONSTRUCTION – BRALEY LANE

Sitting: Peter Conner, William Keohan, David Peck, PersonNameMarc Betti, and PersonNameMichael Main.

Mr. Peck read the legal advertisement into the record.

Attorney Betters, representing the petitioner, said that the petitioners with seeking a Comprehensive Permit under MGL Chapter 40B for four condominium units under the Local Initiative Program (LIP).  The units will be free-standing with 3-bedrooms.  Three at market rate, one affordable.  Town water and sewer is in the area.  Access was proposed off addressStreetBraley Lane and addressStreetFieldstone Way (a private easement approximately 20’ wide). The petitioner was encouraged by the Planning Board to use addressStreetFieldstone Way and the petitioner got an agreement to grant an easement from Mr. Smith.  The placeCityPlymouth Center Steering Committee, the Affordable Housing Committee and the Planning Board all recommended approval.   The abutters submitted a letter stating concerns with the project to the Zoning Board office which was forwarded to my office.  A plan was submitted eliminating the access off addressStreetFieldstone Way.  

Mr. Chandler, one of the petitioner’s said that the original proposal was to build two duplexes with a single access off addressStreetBraley Lane.  Fieldstone Way is not in correct location according to Town documentation.   The rain garden is smaller with the one access off addressStreetBraley Lane.

Mr. Fuller, Landscape Architect, said the site is terraced.  The grade change runs from 8’ to 10’.  There is a steep slope to the back of the property.  The landscape will be enhanced.  The rain garden will take all the drainage.  A wooden fence will be installed for privacy.  No dumpsters are proposed.  The driveway will have lanterns on an 8’ high pole.  There will be fieldstone walkways.  No sprinklers.  Regular mailboxes will be placed out front.

Attorney Betters said all drainage is contained on site.

Mr. Kotowski reviewed the site and the drainage.

Mr. Chandler said that he would build the first two units and then the second two.  The affordable unit will be constructed first.

Attorney Cutler asked the petitioner about the timing for the site improvements.

Mr. Chandler replied that the improvements will be done all at once.   The market rate units will have 2 ½ baths.  The affordable unit will have 1 ½ baths.

Attorney Betters said that the sight distances will be better than what exists now.  No construction vehicles will use addressStreetFieldstone Way.

Mr. Keohan asked the petitioner how long he expected the project to take.

Mr. Chandler replied that they would like to have the project completed within six months.

Mr. Kotowski said that the grass swale will catch most of the run off.  Leaching pits will be used.  The drainage that exists there now is an ANR plan gone wrong.  There will be no discharge on Fieldstone or addressStreetBraley Lane.  All drainage will be kept on site.

Attorney Betters reviewed the conditions as stated in the Planning Board recommendation noting that Condition No. 3 does not apply.  Condition No. 4 the front of the building will be “hardie plank” the sides and back will be white cedar shingles.   Condition No. 11 does not apply to condominiums.

Mr. Peck said that he would like the Fire Chief and Town Engineer review the new plans.  Stating he would also want to see the landscaping and lighting prior to final approval. .

Mr. Peck moved to continue Case No. 3405 to April 25, 2007 at 7:45 p.m. to allow the Board time to review the revised plans.

Mr. Main seconded.

Unanimously continued.

No further business came before the Board.
